Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the EnduroFit mobile app and endurofitapp.com (together, the “Service”), operated by Moto Essentials (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you're under 18, you should review these Terms with a parent or guardian, since the Service involves physical training and, in some cases, real payments.

The Service

EnduroFit provides training plans, nutrition tracking, ride tracking, cramp-risk scoring, and group riding features for enduro and off-road motorcycle riders. endurofitapp.com is our marketing site, where you can join the waitlist and preorder merchandise.

App subscription

EnduroFit offers an optional auto-renewing subscription for full access to its training, nutrition, and ride-tracking features, purchased as an in-app purchase through the Apple App Store or Google Play:

Payment is charged to your Apple ID or Google Play account at confirmation of purchase (or, for trials, when the trial ends). Your subscription automatically renews for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the current period ends.

Subscriptions are billed and managed by Apple or Google, not by Moto Essentials directly. To cancel, switch plans, or request a refund, use your Apple ID or Google Play account settings — refunds are granted according to Apple's or Google's own policies, not ours. If we change subscription pricing, we'll provide notice before it applies to your next billing cycle.

Not medical advice — assumption of risk

EnduroFit's training plans, nutrition suggestions, hydration and electrolyte guidance, and cramp-risk scores are provided for general informational purposes only and are not medical advice. They are not a substitute for consultation with a physician or other qualified healthcare provider, especially if you have an existing medical condition. Always consult a doctor before beginning a new training program.

Off-road and enduro motorcycle riding, and physical training in general, carry an inherent risk of injury. By using the Service, you acknowledge that risk and agree that you are solely responsible for your own safety, equipment, and decisions on and off the bike.

Preorders, pricing & payment

Cancellations, returns & refunds

You can cancel or change a preorder any time before it ships by emailing support@endurofitapp.com. Once your item ships, you can return an unworn, unwashed item within 30 days of delivery for a refund or exchange — just email us first so we can help. If an item arrives damaged or defective, or the wrong size ships, we'll replace it or refund you at no cost to you. We reserve the right to cancel and fully refund any order we're unable to fulfill.

Accounts & community conduct

You're responsible for the activity on your account and for keeping your login credentials secure. If EnduroFit's group chat and ride-planning features are used to harass, threaten, impersonate others, share illegal content, or spam other riders, we may remove that content and suspend or terminate the account involved.

Intellectual property

EnduroFit, the EnduroFit logo, and the Moto Essentials name and marks are the property of Moto Essentials. You may not use them without our prior written permission. You retain ownership of any content you create in the app (like ride notes or messages), but you grant us a license to store, display, and process it as needed to operate the Service.

Third-party services

The Service relies on third-party providers, including Firebase (app data storage and authentication), Stripe (merchandise payments), Resend (email), Convex (website data storage), and Vercel (hosting), as well as Apple Health, Google Health Connect, and Strava for optional data sync. App subscriptions are billed separately through the Apple App Store or Google Play, as described above. We aren't responsible for outages or issues caused by those third parties. If you connect Strava, that connection is also subject to Strava's own terms of service and privacy policy.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that any training outcome is achieved.

Limitation of liability

To the fullest extent permitted by law, Moto Essentials won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, other users, or third parties.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

Apple App Store Additional Terms

The following terms apply specifically to your use of the EnduroFit app as downloaded through Apple's App Store, in addition to the terms above.

This End User License Agreement is concluded between you and Moto Essentials LLC only, and not with Apple Inc. (“Apple”). Moto Essentials LLC, not Apple, is solely responsible for the app and its content. This Agreement does not conflict with the Apple Media Services Terms and Conditions or App Store Terms of Service to which you have also agreed.

License

Subject to your compliance with these Terms, Moto Essentials LLC grants you a limited, non-exclusive, non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by Apple's Usage Rules set forth in the App Store Terms of Service. This license may be shared among multiple devices associated with your Apple ID via Family Sharing or a similar Apple facility for the applicable number of devices.

Maintenance and Support

Moto Essentials LLC is solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.

Warranty

Moto Essentials LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Moto Essentials LLC.

Product Claims

Moto Essentials LLC, not Apple, is responsible for addressing any claims from you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Intellectual Property

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Moto Essentials LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the app — for example, your wireless data service agreement, if applicable.

Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this End User License Agreement, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles.
